Overview

Heritage Finance Pty Ltd (“we”, “us”, “our”) collects information about you for the purposes you agree to in this Privacy Disclosure Statement and Consent. By signing this document you agree we may, consistent with Australia’s privacy and credit reporting laws, collect, use and exchange credit and personal information about you for those purposes.

Why we collect your information

  • To source for you (or a company of which you are a director):
    • Consumer credit for personal, household, domestic or residential investment purposes;
    • Commercial credit for business purposes; or
    • Other services stated in this Consent;
  • To support a guarantor application you will provide.
As your broker, we require this information to assess your (or a company’s) credit or guarantor application, to source a suitable credit provider and any required insurances, and to manage the application process. If you do not provide the information sought, we may be unable to process the application or may be limited in the services we can offer.

Collection & Credit Reporting Bodies (CRBs)

  • We may disclose your identification information to a CRB to obtain a credit report on your behalf.
  • We may use information from a CRB to assist our preliminary assessment of your consumer credit or guarantor application.
  • We may disclose your personal information to insurers to source insurances you wish to obtain.
  • We may disclose your credit information to credit provider(s) to apply for finance on your behalf.
Information we obtain from you is used only for the purposes listed in this document and is not disclosed to any other person except with your permission or as permitted/required by law.

Credit Providers

We may perform tasks for a credit provider necessary to manage the application process (acting as the provider’s agent, subject to the same privacy law requirements). We may submit your application to one or more providers (see “Schedule of Credit Providers” below). Providers may disclose information about you to, and collect information about you from, one or more CRBs. Each provider’s website outlines its credit reporting details (“notifiable matters”), policies, and how to exercise your rights.

Your rights

  • Ask us for all information we hold about you and to correct any incorrect information.
  • Request copies of our Privacy Policy and this document in your preferred form (hardcopy or email).
  • Ask a CRB not to use your information for direct marketing pre-screening or to release it if you believe you’re a victim of fraud.

Disclosure & Consent

By signing, you agree we may:
  • Use your personal and credit information to assess applications, source finance and insurances, and as authorised or required by law.
  • Disclose to/obtain from prospective credit providers or insurers information reasonably necessary for finance and insurances.
  • Provide your information (including credit report(s)) to provider(s) in the Schedule so they can assess your application or suitability as guarantor.
  • Provide credit information to a guarantor/prospective guarantor.
  • Provide you (or your company) offers of other goods/services from us or associated entities (unless you opt out).
  • Disclose information to service providers (contractors, agents, printers, mail houses, lawyers, custodians, securitisers, IT providers — including in NZ, Philippines, India, Singapore, USA) so they can perform services for us.
  • Disclose information to an organisation that acquires, or seeks to acquire, an interest in our business or rights under your contract.
You also consent to the following where applicable:
  • A CRB disclosing your consumer credit information to one or more listed credit providers to assess applications (including as guarantor).
  • Credit providers disclosing your credit information (including from a CRB) to a guarantor/prospective guarantor.
  • Credit providers disclosing to other credit providers information they hold about you for specific purposes.
Where the applicant/guarantor is a company of which you are a director, you consent to the use of your information (in addition to the company’s) in the ways listed above.

Authorisation

By signing below, you authorise us to request your consumer and commercial credit-worthiness information from a CRB to assist us in providing our services. This authorisation ceases when we undertake a task on behalf of a credit provider.
